Every business in our country is affected by regulations. There are tax regulations, regulations governing the hiring of staff, workplace safety regulations and specific regulations affecting the type of business you operate. Despite the myriad of regulations mandating the way businesses are to be operated, many business owners do not have a thorough understanding of the regulatory process. Access to expertise in regulatory matters is one of the many benefits of joining an association such as NATA.
The regulatory process is often an involved, slow moving machine that can take years to reach a final rule. While this may seem maddening at times, it was designed to be that way to help ensure that proposed regulations are thoroughly evaluated by the public and the regulators themselves before being finalized. Because of the nature of the regulatory process, it is easy for a business owner or manager to lose track of where specific regulations are in that process.
Here in the first week of 2011, we thought it would be appropriate to look back at some of the major regulatory issues of 2010.
2010 saw significant debate on the appropriateness of residential TTF agreements at public use airports. After receiving comments on a proposed policy on those agreements, the FAA will now finalize its policy in 2011.
It was a very busy year for regulatory issues affecting flight training at both the federal and state level. Following are a few of the major issues that were addressed last year.
One of the major issues affecting maintenance facilities was the issuance of proposed rules affecting repair station security. The rules would subject certificated repair stations to TSA security oversight and the issuance of security directives.
Part 135 On-Demand Charter
Late last year, the FAA issued proposed rules on flight crew duty and rest requirements for Part 121 carriers but noted in the text of the rulemaking that Part 135 operators would eventually be subject to rules that were “very similar to, if not exactly like” the 121 rule.
While 2010 did not see the implementation of a “Cap & Trade” program as many had thought, there were still several issues that directly affected our industry.
Next Up In 2011
There are several issues from 2010 (and earlier) that will be in the forefront this year, including the TSA issuance of a revised Large Aircraft Security Program (LASP).
